Severance Pay in South Africa (2026/2027)
The Basic Conditions of Employment Act (BCEA) entitles employees dismissed due to operational requirements (retrenchment) to severance pay of at least 1 week's remuneration for each completed year of continuous service. This is the legal minimum โ employers can offer more.
Weekly remuneration is calculated as the monthly salary multiplied by 12, divided by 52. Only completed years of service count towards severance โ partial years are not included in the BCEA calculation. For example, an employee with 5 years and 8 months of service would receive severance for 5 completed years only.
Severance pay is only required when an employee is retrenched (dismissed for operational requirements). It is not payable when an employee resigns voluntarily, is dismissed for misconduct, or is dismissed for incapacity unless the employment contract provides otherwise.
For tax purposes, severance pay is treated as a "severance benefit" and taxed under the lump sum tax tables. The first R500,000 of combined lifetime severance benefits and retirement fund lump sums is tax-free. This lifetime limit includes any previous severance or retirement lump sums received.
